1. Terms and Conditions

1.1. These terms and conditions constitute the contract between the User and Safeway Ibérica, Lda. in the scope of providing online services on the website www.tacasremote.com. By accessing the website www.tacasremote.com and using the services provided, whether in the demo version or the professional version through the purchase of services available in the catalog, the user agrees to be bound by the terms and conditions ("terms and conditions") described on this page. Safeway Ibérica, Lda. reserves the right to update and change the terms and conditions periodically and without prior notice.

1.2. Safeway Ibérica, Lda., is a company with headquarters at Limites de Vale Flores Pavilion G, 2710-632 Sintra, Portugal, registered with the Commercial Registry of Sintra under number 19478 in the year 2002, with Tax ID number: 506218651, hereinafter referred to as Safeway Ibérica, Lda.

1.3. The user of the remote assistance service license is an individual or legal entity that subscribes to and pays for the services provided on the website www.tacasremote.com, identified by the data provided when requesting technical support or purchasing a license to use the Tacasremote remote assistance service according to the product catalog available on the website www.tacasremote.com.


2. Conditions of Use

2.1. The User needs to have access to the Internet, a computer with a Windows Operating System, and an up-to-date browser (Internet browsing program) to remotely access another computer that meets the same technical requirements.
The user of the paid remote assistance license or demo, provided by Safeway Ibérica, Lda., on the website www.tacasremote.com, assumes their own risk in using the license and the provided services. Services are provided "as is" and "as available." Technical support is provided exclusively through Remote Assistance or telephone support, to users and holders of a paid Usage License according to the schedule defined by Safeway Ibérica, Lda.

2.2. Services can only be provided to users aged 18 or older. The User agrees to provide complete and truthful information on the website www.tacasremote.com owned by Safeway Ibérica, Lda., and to keep this information up-to-date. Full name, a valid email address, and any other information requested by the service provider as adequate proof of identity, domicile or residence, or potentially, their status as a legal representative.

2.3. The use or access to the services provided by Safeway Ibérica, Lda., whether it's a paid or demo remote assistance license on the website www.tacasremote.com, implies the User's acceptance of these terms and conditions. The user can review the most current version of the terms of service at any time on the website www.tacasremote.com on the Terms and Conditions page.
2.4. This contract shall be considered concluded after the User registers their access data on the website www.tacasremote.com and accepts these terms and conditions, which are presented on the registration form page, whether it's for a demo or professional remote assistance license.
Violation of any of the conditions set forth in the Terms and Conditions gives Safeway Ibérica, Lda. the right to terminate the user's account.

2.5. Providing incomplete, incorrect, or false information, as well as non-compliance with any of the provisions of these terms and conditions, may result in immediate and without prior notice termination of the service to the User.

2.6. The User undertakes to protect and keep their access data to the service confidential, not disclosing them or sharing them with third parties. Logging into your account can only be used by one user, and sharing the login with third parties is not allowed.

2.7. The User is solely responsible for maintaining the security of their account and personal, individual, or private password. Safeway Ibérica, Lda. cannot and will not be held responsible for any loss or damage resulting from the user's failure or failure to comply with this security obligation. The user must take preventive measures and provide security guarantees to prevent the transmission of any viruses, worms, or any code of destructive nature.

2.8. The User acknowledges that they are solely responsible for the content stored or transmitted using the services provided by Safeway Ibérica, Lda. By submitting or disclosing this content in areas of the publicly accessible services, the user declares ownership of this content, exempting Safeway Ibérica, Lda. from any liabilities. The Services are provided "as is" and "as available." The user assumes all risks and costs associated with using the Tacasremote license, Remote Assistance services provided by Safeway Iberica, Lda., but grants Safeway Iberica, Lda. the power to issue documents and content. The user may not use the services for any illegal, unauthorized, fraudulent, or non-authorized purposes. In the use of the Tacasremote License, the user may not violate any laws of any jurisdiction (including, but not limited to, copyright laws).

2.9. New features, content, and functionality provided on the website www.tacasremote.com are subject to the conditions set forth in these Terms and Conditions of Service. The user's continued use of the services after any changes occur constitutes express consent to such changes.


3. Contact Information

3.1. Safeway Ibérica, Lda. uses email and SMS as its preferred means of communication with the User, and it is the User's responsibility to keep the email address and contact mobile number up to date and check their respective mailbox or message box regularly, including the "SPAM" folder.


4. Unauthorized Use

4.1. The User is prohibited from overloading the service provided by Safeway Ibérica, Lda. or the underlying computer network. The User agrees to make every effort to keep the use of the provided resources within the limits established for the service and acknowledges that excessive use may cause the service provided to become inoperative or suspended.

4.2. The User is prohibited from reselling or transferring the services provided by Safeway Ibérica, Lda. to third parties.

4.3. The User agrees not to engage in or encourage illegal acts, as well as not to use the service to harm, threaten, or harass third parties.


5. Change of Terms and Conditions

5.1. Safeway Ibérica, Lda may change these terms and conditions at its discretion, with the User being informed via email or SMS of any changes with a minimum of 15 (fifteen) days' notice.


6. Electronic Invoice Issuance

6.1. The electronic invoice is an electronic document (dematerialized) legally equivalent to the conventional paper invoice. The electronic invoice includes an advanced electronic signature that guarantees the authenticity of its origin and the integrity of its content.

6.2. Sending and Receiving Electronic Invoices

6.2.1. The User may choose to subscribe to or unsubscribe from receiving electronic invoices at any time.

6.2.2. By subscribing to electronic invoice receipt, the User receives invoices issued by Safeway Ibérica, Lda. directly by email in PDF format.

6.2.3. The electronic invoice is issued within 72 hours following the purchase and payment of the license or renewal of the License for the use of the service acquired on the website www.tacasremote.com. It is considered received by the User unless the User claims its absence via email to suporte@tacasremote.pt.


7. Cost and Payments

7.1. The contract for services provided by Safeway Ibérica, Lda. on the website www.tacasremote.com to the User is a paid service, non-refundable, and is made available only upon receipt of the respective payment. The service duration is annual, monthly, or on a standalone request basis, depending on the contracted service, and it is renewed if the user makes a new payment.
Payment for the Service or Account will be made preferably through bank transfer or Mbway. The service is charged in advance, according to the contracted periodicity or prepaid plan. There will be no refund or credits for partial months of Service, upgrades/downgrades, or refunds for unused months with an open account. No exceptions will be considered based on the principle of equality.

7.2. The cost of the service is presented on the website www.tacasremote.com and is subject to change. In the event of a price increase, the User will be informed via email with a minimum of 15 (fifteen) days' notice. The user is responsible for paying any fees, taxes, or tax obligations, and rights for using the Service.

7.3. If the user performs or intends to upgrade their license, payment for this service will be immediately and automatically due, payable in the immediately following billing period, and payment may be requested by Safeway Ibérica, Lda. via bank transfer to a bank account to be provided to the user.

7.4. The price of the Service for a particular User cannot be reduced nor subject to renegotiation with Safeway Ibérica, Lda.


8. Validity

8.1. This contract comes into effect on the date of the User's service subscription and is valid for the duration of the prepaid service, expiring at its term. The User is notified by email, with a minimum of 10 (ten) days' notice, regarding the expiration date of the service.


9. Service Suspension

9.1. In case of non-payment or delay in payment of the contracted License, Upgrade, or Remote Assistance, the provision of the service to the User will be suspended.


10. Resolution

10.1. The User may terminate the contract at any time by simply informing Safeway Ibérica, Lda. of this intention.

10.2. Safeway Ibérica, Lda, at its sole discretion, has the right to suspend or terminate the account of any user and refuse any and all use of the service, current or future, or any other service provided by Safeway Ibérica, Lda., for any reason, at any time. The closure of the service results in the deactivation and/or deletion of the user's account or the user's access to their account.

10.3. Safeway Ibérica, Lda reserves the right to refuse the provision of the service to any individual or legal entity for any reason, at any time.

10.4. After the user's service cancellation request, all account data will be immediately deleted and cannot be recovered.


11. Service Maintenance

11.1. Safeway Ibérica, Lda reserves the right to modify, discontinue, or temporarily suspend (in whole or in part) the provision of the service without prior notice or with 30 (thirty) consecutive days' notice in the case of permanent discontinuation. Whenever possible, the User will be notified in advance via email or SMS of scheduled maintenance operations that may cause disruptions in the provision of Remote Assistance or Version Upgrade services, whether paid or provided for free.

11.2. Safeway Ibérica, Lda may discontinue the service or part of it whenever it deems it necessary to make changes or corrections. The user expressly accepts that Safeway Ibérica, Lda will automatically provide such corrections as part of the service, along with any inherent disruptions.

11.3. As part of the service, Safeway Ibérica, Lda may also make temporary discontinuations and modifications to the Service, resulting from software issue corrections, feature enhancements, general improvements, or even entirely new versions of the service, aimed at improving its provision, thus aiming for maximum satisfaction and benefit for the user. Safeway Ibérica, Lda will not be liable to the user or any third parties for any damages that may result or arise from the cessation or suspension of services or the discontinuation of their Tacasremote License.

11.4. The prices of all Services, including but not limited to monthly subscription fees for the Service plan, are subject to change with 30 days' prior notice.
This notice may be provided at any time through changes posted on the website www.tacasremote.com, within the Service itself, by email, or SMS.

11.5. The user or third parties may not hold Safeway Ibérica, Lda. contractually, extra-contractually, criminally, or in any other way liable for any modification or alteration of prices, suspension, or termination of the Service.


12. Copyright and Content Ownership

12.1. All rights to the Service are reserved by Safeway Ibérica, Lda., the owner of the source code and copyrights of the Algorithm used by Tacasremote. The user acknowledges that the service contains protected and confidential information that is protected by applicable law. All software developed by Safeway Ibérica, Lda. for the provision of the service is its sole and exclusive property, and only its use is an integral part of the service provided, and the copyright in the software is the exclusive property of Safeway Ibérica, Lda., as well as the right to market, distribute, and provide technical support.

12.2. The user may not duplicate, copy, reproduce, redistribute, or reuse any part of the Site, Service, or Account. Texts, images, graphics, downloads, audio, videos, animation, and all other information along with the way they are graphically represented on the website and in our products are all subject to the copyrights of Safeway Ibérica, Lda. Safeway Ibérica, Lda. does not grant you a license or ownership rights to the Materials and Information, so you do not have the right to reproduce them for any purpose other than personal use. Neither the website nor the product, nor any part thereof, may be copied, distributed, modified, or placed elsewhere without prior written permission from Safeway Ibérica, Lda., under penalty of incurring civil and criminal liability.

12.3. Links to Third-Party Pages and Services
Safeway Ibérica, Lda. may provide links to third-party pages on its website and products. These websites or products may not belong to or be operated or controlled by Safeway Ibérica, Lda., and for this reason, Safeway Ibérica, Lda. is not responsible for their content. Your use of these links is entirely your responsibility.


13. Legislation and Jurisdiction

13.1. These terms and conditions are governed by Portuguese law. To resolve disputes arising from this agreement, the court of Sintra, Portugal, is considered competent, with express waiver of any other.


14. Limitation of Liability

14.1. Safeway Ibérica, Lda does not guarantee the suitability of using the Tacasremote license for any specific purpose. It is the sole responsibility of the User to ensure that the features of the software or service, as indicated on the website www.tacasremote.com, meet their particular needs and that they comply with all applicable legal provisions in their specific situation.

14.2. Safeway Ibérica, Lda does not guarantee that the provision of the service will be uninterrupted or error-free and disclaims all responsibility for data loss resulting from delays, non-delivery, or incorrect delivery, as well as for any interruption in the provision of the service. The User agrees that Safeway Ibérica, Lda. will not be held liable for any resulting damages. Furthermore, the User acknowledges that Safeway Ibérica, Lda.'s liability for its own negligence shall not exceed the amount of the monthly fee paid by the User for the service during the period in which the damages occurred. Safeway Ibérica, Lda. shall not, under any circumstances, be liable for consequential, special, direct, or indirect damages.

14.3. The user expressly understands and agrees that Safeway Ibérica, Lda. cannot be held liable, not even for negligence, for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to: damages for lost profits, good faith, misuse, data, or other intangible losses (even if Safeway Ibérica, Lda. has been warned of the possibility of such damages), resulting from your use of the website or third-party products that access data through the Site.
Safeway Ibérica, Lda. does not guarantee that the service will meet specific needs, that the service will be uninterrupted, timely, secure, or free from errors, viruses, and worms, that the results that can be obtained from the use of the service will be accurate or reliable, the quality of products, services, information, or other materials acquired or obtained by the user through the service will meet their expectations, and that all errors in the service will be corrected. The user expressly understands and agrees that Safeway Ibérica, Lda., as the owner of the Copyrights of the Algorithm used as well as the exclusive source code of Tacasremote, shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:
damages for lost profits; goodwill; use; data or other intangible losses (even if Safeway Ibérica, Lda. has been warned of the possibility of such damages), resulting from: the use or inability to use the service, the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through the service, unauthorized access or alteration of your transmissions or data,
(iv) statements or conduct of third parties regarding the Service;
(v) or any other issues related to the use of Tacasremote or the services provided by Safeway Ibérica, Lda.

14.4. Discontinuation
Safeway Ibérica, Lda. reserves the right to modify or discontinue, temporarily or permanently, your access to the website (or any part thereof or service) at any time, with or without notice.


15. Privacy Policy

15.1. Safeway Ibérica, Lda., as the service provider, guarantees the user privacy, confidentiality, security, portability, and the right to removal of the data entered in their account.
However, Safeway Ibérica, Lda. cannot be held responsible for external acts the responsibility of individuals or organizations external to Safeway Iberica, Lda.

15.2. At the time of entering into the service provision contract, Safeway Ibérica, Lda. requests from the user the strictly necessary personal data for the creation of the user's account. These data are used solely for commercial purposes, namely for billing, sending information about their account, updating existing services, and sending marketing communications exclusively from Safeway Ibérica, Lda.

15.3. The user's personal data will never be disclosed or provided to third parties without the user's express consent, except if the user violates the terms and conditions of use of the service. In this case, the user's personal data may be used for civil, administrative or criminal liability purposes.

15.4. Safeway Ibérica, Lda. will provide the user's account data if judicially notified or summoned to do so.

15.5. At any time, the user may update, change their personal data, or request their complete removal by sending their intention in writing to the contacts of Safeway Ibérica, Lda.

15.6. Safeway Ibérica, Lda. reserves the right to change the clauses related to the privacy policy of the service at any time. If significant changes are made, Safeway Ibérica, Lda. will notify the user with 24 hours' notice.

15.7. These conditions are aimed at ensuring the user a safe and effective use of the service provided by Safeway Ibérica, Lda.
